Welcome to the sittingonasofa.co.uk website. By accessing this website you agree to our terms and conditions. If you do not agree to them you may not use this website and should leave it immediately.

Sittingonasofa.co.uk is an online service of Sitting On A Sofa Limited. At sittingonasofa.co.uk we provide solely for your personal use for the sale of clothing and accessories.

At Sitting On A Sofa we have taken great care to ensure that the Items on our website are presented as accurately as possible. However colour clarity will depend upon your own personal monitor and we therefore cannot guarantee that the colour of the actual Item is absolutely accurate. Before placing an order please read through these Terms and if you have further queries please contact our Customer Care Team customercare@sittingonasofa.co.uk.

To be eligible to purchase Items on our Website you must:
  1. a) be the holder of a valid debit/credit card
    b) warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects

If your personal information changes then please notify us immediately by contacting our Customer Care Team on the following email customercare@sittingonasofa.co.uk.

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

By using our site you agree to comply with, and be bound by our Terms.

We may from time to time change these Terms at our sole discretion. By using this Website after any such change(s), you agree to comply with, and be bound by, the Terms as changed.

2. Making a purchase

When you order an Item from sittingonasofa.co.uk you are offering to buy it for the price stated, subject to these Terms.

You will be guided through the process of placing an order by a series of instructions on the Website. You place your order for Items from the Website by clicking on the add to cart button at the end of the online order process.

Once you have placed your order, we will send you an email confirmation with the exact details of your order, providing you with a payment reference and the value of your order that will be debited from your credit/debit card.

Our acceptance of your order will be deemed complete and received by you once an email has been sent to you confirming your order has taken place.

If you require any information regarding your order(s) please email our Customer Care Team 24 hours a day, seven days a week on customercare@sittingonasofa.co.uk. 

We may not accept your order:

  1. If your card is due to expire within 28 days of your purchase date
  2. We are unable to obtain authorisation for your payment
  3. If we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time and at our sole discretion

If we are unable to fulfil your order following our order acknowledgement, we will contact you by email or telephone advising you of this.

We will try to keep our Website as up to date as reasonably possible, but cannot guarantee that any particular item will always be available. If we cannot supply any item we will release the funds being held in your account for the purchase.

3. Products & Pricing

When you order an item from sittingonasofa.co.uk you are offering to buy it for the price stated, subject to our Terms. Prices and products displayed on our website are subject to change. We will notify a Seller to confirm they are happy with these changes before they take place except when the price displayed was incorrect and that pricing error was obvious and unmistakeable. Therefore the prices on the w  febsite could change at any moment to be replaced by the correct price.

Prices shown on our website are in GBP and are inclusive of VAT. However other taxes imposed by the applicable governmental authority may apply including import duties and taxes.

The price of a product does not include delivery charges or any relevant import duties and taxes. Delivery charges will be shown on the product description page.

Prices are approximate and may vary depending on year and source of purchase.

4. Orders

All users of the website wishing to buy or sell with Sitting On A Sofa Limited will be asked to register on the website by providing us with your name, email address, phone number and relevant home address. We will also ask you to create a username and password.

You must keep your username and password confidential and must inform us if you suspect or discover that your username or password have become know to someone else.

You will need to use your account to purchase the products or list products with us in accordance with the process outlined on our website.

For products listed or purchased; we will deduct payment for the product from the Buyer’s account when the Buyer submits their payment details on the website and purchases the product with Sitting On A Sofa.

An email will be sent to the seller to notify them that the product has been sold and another email will be sent when the product has been paid for. Delivery of the product will then be arranged and sent to the Buyer directly from Sitting On A Sofa.

Should we be unable to obtain authorisation for the payment of your purchase or we believe a transaction is fraudulent or you do not meet the eligibility criteria set out within these Terms then an order may be refused.

We allow 14 days for returns please see our Returns Policy for more information. You can see our returns policy on each item page.

Once payment can be processed we will deduct our commission plus VAT if applicable before transferring the balance of the sales proceeds to the Seller’s nominated account.

5. Delivery

Shipping costs will apply to your order. Our delivery charges are dependent on your shipping destination. Please refer to our delivery section to view timing and costs. Estimated delivery times are to be used as a guide only. Sittingonasofa.co.uk cannot take responsibility for delays owing to The Royal Mail or to customs clearance or payment issues. All purchases are insured by sittingonasofa.co.uk while in transit until it delivered to you. Any delivery charges displayed do not include any relevant import duties or taxes. If you have any issues in regards to delivery you can contact our customercare@sittingonasofa.co.uk and we will look into tracking it for you.

If a buyer orders product from our website sittingonasofa.co.uk for delivery internationally, the order may be subject to import duties and taxes which are applied when the delivery reaches that destination. At Sitting On A Sofa we have no control over these charges and we cannot predict their amount. Buyer should check whether they are liable to pay import duties and taxes prior to purchasing any of the product listed on sittingonasofa.co.uk.

The Buyer will be responsible for payment of any import duties and taxes. Buyers are advised to contact their local customs office for further information before placing an order.

If your order is not delivered within the timeframe specified at ordering we will notify you and try to rectify the situation as quickly as is practically possible.

All new orders are deemed separate and each is treated individually and with great care and attention.

At sittingonasofa.co.uk online purchases may be delivered to addresses other than the billing address given by the card holder, for example as with the case of a gift being purchased and addressed to a friend, as a security precaution, an email and a copy of the invoice will be sent to the cardholder’s registered email address and home address, and we will require a signature upon delivery for all goods shipped in this instance.

Buyers and Sellers shall be responsible for providing us with up to date contact details in their Customer Account.

6. Returns & cancellations

Customer satisfaction is our top priority. We will handle each query on an individual basis to the best of our ability. We hope that you will be delighted with your order however if you are not perfectly satisfied with your goods we will happily offer you a full refund. Please read our return policy carefully to ensure you can proceed with your request as quickly as possible.

All returns should be sent back to us in their original packaging provided. Please ensure when returning the parcel that the sittingonasofa.co.uk goods are properly protected with the plastic bag provided.

Please note that unless the product is faulty or not as described the Buyer will be required to meet the cost of returning any product to sittingonasofa.co.uk.

If a Buyer would like to cancel an order you will need to contact our Customer Care Team by email customercare@sittingonasofa.co.uk to inform them of the reason for your purchase cancellation.

You have 14 days from receipt of order to return your goods. Return outside the 14-day window may be accepted at our discretion. The item(s) should be returned in perfect condition as you received them, with all sittingonasofa.co.uk and designer garment tags still attached. Returns that are damaged, soiled or returned without the original labels may not be accepted and may be sent back to the customer.

Before your parcel leaves our Head Office, it is fully checked by our team. If you receive an item which is damaged, please contact us immediately. Where provided, any designer packaging such as authenticity cards, dust bags and leather tags should be included in your return to be able to receive your full refund.

Returning Goods from Non-EU Countries – If you are living outside the EU, you will also have received a Proforma Invoice with your package. This needs to be completed and enclosed with the items you wish to return. On this form you will need to indicate which item(s) are being returned by ticking the boxes alongside the product details. All successfully returned items will be only credited to the account used originally to purchase the items, less any taxes, import duties or original shipping charges incurred and will be refunded in the currency in which you paid at the price you paid at the exchange rate prevailing on the day when you bought the item. Our returns policy does not affect your statutory rights in any way. For further information on our returns, including the process to follow to cancel an order and return any products please see our Returns policy on our website.

7. Payment & charges

We accept payment through Stripe.

The charges for the products are set out in the confirmation that the Buyer will receive after their purchase.

Payment for the products and all applicable delivery charges will be in advance of receiving your goods. We will charge the Buyer’s debit card or credit card or Paypal account when the order is placed.

Sittingonasofa.co.uk allows orders to be processed online only we will not except payment for any order over the phone or via email.

Your credit card company may undertake an additional security check to confirm it is you making the order. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

Failure to make the payment & charges incurred when purchasing your product will allow us the right to suspend or close any Customer Account or otherwise restrict access to our website and the products.

8. Payment & charges

We have certain rights under the law, including that any Items you order through our website will be of satisfactory quality in accordance to any description provided on the product description page, fit for their intended purpose, and will conform to your order on our website.

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into these Terms.

We only supply the items, use of the website and any other services for domestic and private use. You agree not to use the items, Website or any other services provided by us for any commercial, business or re-sale purpose, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. Further, you agree that we are not responsible or liable under any circumstances for any computer viruses, system failure or malfunction which may occur in connection with your use of our website.

In no event shall our maximum aggregate liability exceed the greater of one hundred pounds (£100.00) or the sum you have paid us for the Item in which you have purchased and are claiming against.

We do not exclude or limit in any way our liability for (i) death or personal injury caused by our negligence,(ii) fraud or fraudulent misrepresentation, (iii) any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession), (iv) any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples), (v) defective products under the Consumer Protection Act 1987, or (vi) any other liability which cannot be excluded by law.

9. Our rights to change these Terms

We may revise these Terms from time to time. Every time you place an order the Terms in force at that time will apply to any corresponding orders placed.

10. Obligations

You as a Buyer or Seller will ensure that the information you include in your use of our website is complete and accurate at all times.

You as a Buyer or Seller will ensure that you only purchase or sell products if you are at least 18 years old.

11. Termination

At sittingonasofa.co.uk we may terminate our agreement with you with immediate effect by notice in writing to you if you are in breach of any term of this agreement.

12. Consequences of termination

Upon termination of this agreement for any reason you shall immediately pay to us all of our outstanding invoices and interest.

The accrued rights, remedies, obligations and liabilities of each party as at expiry or termination shall not be affected, including the right to claim damages in respect of any breach of the agreement which existed at or before the date of termination or expiry.

13. Confidentiality

Each party shall keep in strict confidence all information which is of confidential nature and which has been disclosed by one party to the other party.

14. Disputes

All intellectual property rights in or arising out of or in connection with the product shall as between you and us, be owned by us.

These Terms are only available in the English language.

If any of these Terms conflict with any terms of an order, the order will take priority.

This agreement is between you and us at Sitting On A Sofa Limited. No other person shall have any rights to enforce any of its terms, whether under the contracts (Rights of Third Parties Act) 1999 or otherwise. Each of the sections of these Terms operates separately.

If we fail to insist that you perform any of your obligations under this Agreement, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

If you are a consumer, you have legal rights in relation to the Products. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards Office. Nothing in these Terms will affect these legal rights.

If you are a consumer, please note that the agreement is governed by English law. This means an agreement for the purchase of products and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction in connection with any such dispute or claim.

15. Authenticity of all goods

All product is approved by our team prior to going live on the sittingonasofa.co.uk platform. Buyers are always encouraged to ask any questions prior to purchase by contacting Sitting On A Sofa’s Customer Care Team. All payments for purchased items, are made directly to Sitting On A Sofa. A period of 14 days is allowed for a Buyer to contact our Customer Care Team to request a return and refund from the marked postage date.

13. Notices

Any notice given by us at Sitting On A Sofa to you under this agreement must be in writing and may be served by email or by personal delivery to the person notified or its address. Your address for service of notices shall be your email and or postal address specified in your Customer Account or any address in England, Scotland or Wales, which you have previously notified to us in writing.

Our address for service of notices shall be our address set out in these Terms.

You will inform us in writing of any changes to your billing details, contact details, alternative contact details, authorised persons, insurance details or access details stated in your Customer Account.

14. General

You agree that these Terms, together with our privacy policy constitute the complete and exclusive agreement between us concerning your use of our website and any purchase by you of any items from sittingonasofa.co.uk and supersede and govern all prior proposals, agreements or other communications.

If any provision of these Terms is held to be illegal, invalid or unenforceable in whole or in part, then these Terms shall continue to be valid as to the other provisions and the remainder of the affected provision. Any waiver of any of the provisions of these Terms by sittingonasofa.co.uk shall not be deemed a waiver of any subsequent breach or default and shall in no way affect the other provisions of these Terms.

We reserve the right to refuse to supply Items to any person for any reason whatsoever, to withdraw any Items from the website at any time and/or remove or edit any materials or content on the website. We will not be liable to you or any third party by reason of our withdrawing of any Items from this website whether or not such Items have been sold; removing or editing content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
